Terms of sale and use

These terms apply to the purchase and use of software supplied by High Tide Trading ("we", "us", "our"). By purchasing, downloading or using our software you agree to them. Please read them before you buy.

2. What we supply

We supply algorithmic trading software — Expert Advisors, indicators and related tools — for the MetaTrader platform.

We supply software only. We do not provide financial advice, investment advice, trading signals, portfolio management, account management or any regulated service. We are not authorised or regulated by the Financial Conduct Authority.

3. Licence

When you buy, you receive a non-exclusive, non-transferable licence to use the software for your own trading. You may install and run it on your own accounts and devices.

You may not resell, redistribute, publish, share, rent, lease, sub-licence, decompile or reverse-engineer the software, or make it available to anyone else by any means.

Our software is not locked to a specific account number. That is a deliberate choice, made so you can change broker, run a demo alongside a live account, or move to a new VPS without asking our permission each time. It depends on customers respecting the licence above.

4. Delivery

Software is delivered digitally to the email address you supply at checkout, normally immediately on payment. It is your responsibility to give a working email address and to check your spam folder. If nothing arrives, email us and we'll sort it out.

5. No guarantee of results

We make no representation or warranty that the software will be profitable, will avoid losses, or will perform in any particular way.

Trading involves risk of loss. Any performance information we publish, including backtests, relates to the past or to simulations and is not a reliable indicator of future results. Please read our Risk Warning.

6. Your responsibilities

You are responsible for choosing your broker and account type; for configuring the software, including all risk and position-sizing settings; for monitoring it while it runs; for the hardware or VPS it runs on; and for making sure your use of it complies with the laws and regulations that apply to you.

We recommend you test on a demo account before using any of our software on a live account.

7. Support

We provide reasonable support by email for installation and configuration from purchase. Support covers getting the software running and understanding its settings. It does not extend to advice on what, when or how much to trade.

8. Updates

All future updates to the EA’s will be sent to the email address you provide at purchase.

9. Liability

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited or excluded.

Subject to that, we are not liable for trading losses, lost profits, lost opportunity, or any indirect or consequential loss arising from the use of our software. This includes losses caused by market conditions, broker execution or pricing, platform or connection failures, VPS downtime, or your configuration of the software.

Our total liability to you, however arising, is limited to the amount you paid us for the software.

If you are a consumer, your statutory rights are not affected by anything in this clause.

10. Intellectual property

All software, source code, documentation, images and website content remain our property or that of our licensors. Buying a licence does not transfer ownership of anything.

11. Third-party products and affiliate links

Some pages on this website contain affiliate links to products and services provided by others, including software developers and hosting providers. Where they do, this is disclosed on the page.

We may receive a commission at no additional cost to you, and you are free to purchase directly from the provider instead. We do not develop, control, support or take responsibility for third-party products or services, and any purchase is a contract between you and that provider.

12. Free tools

Some of our software is supplied free of charge. The same licence terms and the same limitations of liability apply to it. Free tools are provided as they are, and we give no undertaking to maintain, update or support them.

13. Termination

We may terminate your licence if you breach these terms, in particular by redistributing or reselling the software. Termination does not entitle you to a refund outside our Refund Policy.

14. Changes to these terms

We may update these terms from time to time. The version that applies to your purchase is the one published on the date you bought.

15. Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If you are a consumer resident elsewhere in the UK, you may bring proceedings in your own jurisdiction.
